Online casinos offering real-money gambling are not a lawful online gaming category in India under the Promotion and Regulation of Online Gaming Act, 2025. The Act prohibits the provision and promotion of online money games, including games based on chance, skill or a combination of the two. The accompanying Promotion and Regulation of Online Gaming Rules, 2026 took effect on May 1, 2026. The restrictions extend to online money gaming services offered into India from outside the country. An offshore licence does not create an exemption.
This is an information and consumer-protection guide, not a list of casino websites to join. It explains how the current national framework treats wagering, why older search results may be wrong, and what users can do when faced with misleading advertising or suspected financial fraud. Specific disputes and the interaction with state legislation require advice from an India-qualified lawyer.
The legal position in India as of November 2026
The national framework draws a line between activities involving money or other stakes with the expectation of a monetary or equivalent return, and forms of gaming that do not use that wagering structure. The distinction is about how a product works, not whether its advertising calls it a game of skill, entertainment or a casino.
| Online activity | Position under the national framework | What users should verify |
|---|---|---|
| Real-money online slots, roulette and blackjack | Online money games are prohibited | A foreign licence does not make the service permissible in India |
| An online game with a monetary stake and potential monetary winnings, even if skill-based | The online money game prohibition also covers skill-based games | Look at staking and prize mechanics, not the label “skill” |
| Online social games without wagers for monetary gain | Permissible category, subject to applicable rules | Check whether payments buy access rather than create a cash-prize stake |
| Qualifying e-sports competitions | Separate recognised category with defined conditions | Assess whether the competition meets the legal criteria |
| Digital games using tokens, credits or virtual items | Classification depends on actual economic value and structure | Do not assume an alternative payment instrument removes wagering characteristics |

What changed between 2025 and 2026?
In August 2025, Parliament enacted the Promotion and Regulation of Online Gaming Act. The law established a national framework intended to prohibit online money games while providing for recognised e-sports and online social gaming. The detailed Rules were notified in April 2026 and came into force on May 1, 2026. They set out classification, registration, safety and grievance processes for relevant lawful online gaming categories.
That sequence matters for search results. An article published before the law took effect may discuss pre-existing court decisions, state gaming rules or earlier definitions of games of skill. Those discussions are not a reliable substitute for checking the Act and Rules now in force.
The Government of India\’s April 30, 2026 briefing states that the online money game prohibition applies irrespective of whether the game relies on chance, skill or both. It also describes restrictions on advertising and related financial transfers.
Do offshore casinos have an exception?
No general offshore exception exists for online money games offered to users in India. Section 1 of the Act expressly addresses services offered within India and services operated outside the territory of India but offered within it. A foreign company\’s licence may describe its position in another country, but it does not establish permission to offer an online money game in India.
Claims such as “international licence,” “available worldwide” or “accessible in India” must not be treated as proof of Indian authorisation. A site can load in a browser without being lawful, and a payment page can accept data without providing enforceable protections.
The Act also prohibits advertising of online money games and the facilitation of associated financial transfers by banks and payment systems. Consumers should be sceptical of posts that explain how to route a deposit through other channels. This guide does not provide instructions for bypassing access restrictions or payment controls.
For examples of unreliable advertising, see how to recognise misleading casino reviews. An article that ranks unapproved gambling sites for Indian users may be both legally problematic and editorially misleading.
Does “skill game” or “social casino” change the answer?
A skill component is not enough to take a wagering product outside the online money game rules. The national law\’s definition covers games of chance and games of skill when they meet the statutory money-game criteria.
Social casino-style apps can be different. Some simulate slots, card games or other casino mechanics without accepting stakes for cash or equivalent winnings. That distinction does not mean every app with the word “social” is automatically compliant. Review how users pay, whether anything of economic value can be won or transferred, and the rules that apply to the service. If a paid feature buys access or cosmetic content, it is not necessarily a wager; if a purchase becomes a stake used to win money or equivalent value, the legal analysis changes.
The 2026 Rules provide mechanisms for the Online Gaming Authority of India to determine game classifications and for relevant lawful categories to seek registration. Registration for lawful social or e-sport activity should never be presented as a licence for online money casino operations.

What about state laws and older advice about online gambling?
India has a history of state-level distinctions involving gambling, betting and games of skill. Some articles still present a state-by-state list as though it alone answers whether someone can play real-money casino games online.
The later national statute is a material part of the analysis. State laws may still matter to other gaming activities or enforcement questions, but their existence does not remove the restrictions established by the 2025 Act. A proper legal analysis must identify the product, money flow, location, legal entities, relevant state provisions and current national legislation together.
A reader should also distinguish a proposed change, a notified law, a rule that has commenced and a final court decision. Headlines sometimes use “legal,” “licensed” and “not blocked” interchangeably even though these claims have different meanings.
Payments, identity documents and consumer risks
Online money gambling offers can expose users to more than a potential lost stake. Risks include impersonation of familiar brands, fake bonus claims, phishing, fraudulent customer-support channels, requests for unnecessary identity documents and disputed payments. The existence of a polished mobile application or a high search ranking does not verify an operator\’s legal status.
Before giving financial or identity information to any online gaming service, check whether its game category is legally permissible and whether the company clearly identifies its entity, data practices and support channel. Avoid entering payment details into links from unsolicited messages, and do not rely on a social-media personality\’s referral code as evidence of compliance.
| Warning sign | Why it matters | Safer response |
|---|---|---|
| “Our foreign licence makes Indian cash play legal” | Overseas approval is not an exemption from India\’s national rules | Consult the Indian statute and official guidance |
| “Use a different wallet to avoid restrictions” | Alternative funding is not evidence of lawful operation | Do not follow payment-bypass suggestions |
| “Pay a fee to unlock your winnings” | Additional payments can be part of a financial scam | Stop payments and retain receipts |
| “Guaranteed returns” or pressure to act today | A promotional claim is not credible evidence | Avoid the offer and report suspicious contact |
| Requests for passwords, OTPs or remote-device access | These can compromise accounts and funds | Do not share credentials or grant access |
Commercial “top casino” lists may omit these warnings because they are designed to drive registrations. The editorial policy and affiliate disclosure explain the distinction between a sourced legal guide and commercially influenced recommendations.
What to do if you suspect fraud or have already paid
If you believe you have been defrauded, act promptly. Contact your bank or payment service through its official app or published number, explain that you suspect unauthorised or fraudulent activity, and ask about available protective measures. Save transaction references, the full website address, relevant messages and screenshots, while keeping passwords and identity numbers out of public posts.
India\’s Ministry of Home Affairs identifies the National Cyber Crime Reporting Portal as a route for reporting cybercrime, including financial fraud. The government also lists the 1930 helpline for assistance with reporting cyber financial fraud. Reporting does not guarantee recovery, but timely notification can be important when financial transfers are involved.
If a lawful social game or e-sport provider has failed to address a grievance, the 2026 Rules describe provider-level complaints and escalation routes under the relevant framework. Those procedures should not be mistaken for a mechanism to approve or recover gambling winnings from a prohibited money game.
If gambling-related spending is affecting relationships, work or financial security, consider seeking support rather than trying to recover money through further wagering. Our responsible gambling guide discusses warning signs and ways to reduce harm.
How this page is researched and updated
This guide uses the Government of India\’s legislation and official ministry communications as its main sources. It does not claim first-hand access to gambling operators, does not list offshore casino offers and does not award casino scores. The article\’s source-check date is November 4, 2026.
New rules, court decisions, regulatory determinations and official consumer warnings can alter the application of the framework. A legal reviewer should check the current position before publishing or making a substantial change. Editorial corrections and updates should be recorded under the site\’s editorial policy.
Frequently asked questions
Are real-money online casinos legal in India in 2026?
The national Promotion and Regulation of Online Gaming Act, 2025 prohibits online money games, and the implementing Rules took effect on May 1, 2026. Real-money online casino games fall within the type of money gaming addressed by that prohibition. This is general information rather than advice on an individual legal matter.
Is an offshore casino legal because its website opens in India?
No. Site accessibility is not authorisation. The Act also addresses online money gaming services offered into India by operators based abroad.
Are skill-based games exempt from the online money game ban?
Not merely because they require skill. The law covers games based on skill, chance or a mixture when the statutory online money game criteria are met.
Are free social casino games allowed?
Games that do not involve money stakes and cash-equivalent returns may fall within the permissible online social game framework, depending on their features and classification. The word “free” in an advertisement does not settle the question.
Can I use cryptocurrency or another payment method to make wagering legal?
No payment method by itself changes the underlying legal classification of an online money game. Be cautious about anyone suggesting a way to evade payment or legal restrictions.
Where can I report suspected gaming-related cyber fraud?
Use the official National Cyber Crime Reporting Portal or the cyber financial fraud assistance helpline 1930. Contact the affected financial institution promptly as well.
